The rules for using Moshpit Studio.

1. Your agreement and account
These Terms are an agreement between you and Moshpit XR, LLC for Moshpit Studio. They cover Studio accounts, Scenes, the editor and viewer, gallery, plans, embeds, integrations, APIs, multiplayer, and support. Other Moshpit products may have separate terms.
You accept these Terms and acknowledge the Privacy Policy when you check the box during paid-plan checkout. If you act for a company or other organization, you confirm that you can bind it to these Terms. A signed order or Enterprise agreement controls if it conflicts with these Terms.
You must be legally able to enter this agreement. If you are under the age of majority where you live, a parent or legal guardian must accept these Terms for you and supervise your use. Keep your account information accurate and protect access to your account.
2. Plans, billing, and cancellation
Your plan controls Studio features and limits, including storage, Scene counts, watermarking, analytics, integrations, APIs, Editor Embeds, and usage allowances. The Free Plan applies when you do not have a paid subscription. Pro Plan and Enterprise Plan features remain available only while the related subscription or written access grant is active.
- Paid subscriptions renew automatically for the billing period you choose until you cancel.
- An upgrade may start immediately. Any prorated charge or credit appears before you confirm it.
- A downgrade starts at the end of the current billing period unless checkout clearly states otherwise.
- A normal subscription cancellation takes effect at the end of the current billing period. You keep paid access until then.
- Permanently deleting your account ends access and cancels the subscription immediately.
- Fees and approved usage charges are non-refundable unless the law or a written offer says otherwise.
You authorize Moshpit to charge your saved payment method for subscription fees, taxes, and approved usage charges. If payment fails or you exceed a plan limit, we may retry the charge, limit paid features, stop uploads, archive content under the stated retention rules, require a plan change, or suspend the account. Enterprise usage charges apply only when your plan or order enables them.
3. Ownership and permission to run Studio
You keep the rights you hold in the Scenes, files, comments, and other material you submit. Moshpit and its licensors own Studio, including its software, viewer, editor, APIs, design, documentation, trademarks, and material supplied by Moshpit. Your plan gives you a limited, non-transferable right to use Studio for lawful purposes.
You give Moshpit a worldwide, non-exclusive, royalty-free license to host, store, copy, process, convert, stream, display, and send your content. We use this permission only to provide and protect Studio, follow your publishing, embed, export, and Remix settings, and comply with law. We may pass the needed permission to companies that help us provide those services.
When you make a Scene Public, you also allow Moshpit to show the Scene, thumbnail, creator name, and description in Studio discovery and Moshpit promotional material. This permission ends for new uses when you make the Scene Unlisted or delete it. Moshpit will not use Scene content to train a general-purpose artificial intelligence model unless you separately opt in.
4. Your content, sharing, and Remix
You are responsible for your content and must have the rights and permissions needed to upload, publish, embed, export, or allow Remixing. This includes rights involving people, private property, music, trademarks, images, video, audio, privacy, and confidential material.
Public Scenes may appear in the gallery and other public areas. Unlisted Scenes stay out of normal discovery, but anyone with a working link may open and share them. Do not upload secrets, payment card data, health information, government IDs, or other sensitive information unless a written agreement with Moshpit allows it.
Turning on Allow Remixing lets another eligible user create an independent copy of the Scene and its files. A Remix starts as Unlisted and uses the recipient's storage. Turning Allow Remixing off stops new Remixes, but it does not remove a Remix that already exists. Existing Remixes and their credit may remain if you change visibility or delete the original Scene or account.
Remix does not give a recipient ownership of material they did not already have permission to use. Creators and recipients must follow any third-party licenses and restrictions.
5. Integrations, APIs, and embeds
- Protect your Embed Integration credentials and replace them if you suspect exposure.
- Use integrations, APIs, and embeds only within your plan, documented limits, and the law. Do not bypass quotas, watermarks, access checks, or usage reporting.
- Give your end users suitable terms and a privacy notice. Get any permission needed before sending their information to Studio.
- Do not send regulated or sensitive personal information unless a written agreement with Moshpit allows it.
- Do not use Studio as the only record for identity, payments, medical matters, safety decisions, or other decisions where a mistake could seriously harm someone.
Moshpit may limit, suspend, or revoke an integration that threatens security, reliability, other customers, or lawful operation of Studio.
6. Community and acceptable use
Other people may see your gallery activity, profile information, and multiplayer presence. You are responsible for what you say in voice chat and for getting permission before transmitting or recording another person.
Do not use Studio for:
- Illegal activity, fraud, infringement, impersonation, or violations of privacy, confidentiality, or other rights.
- Sexual exploitation, non-consensual intimate material, pornography, content that sexualizes minors, trafficking, or credible threats of violence.
- Harassment, hateful abuse, targeted intimidation, doxxing, or material meant to cause serious physical or emotional harm.
- Malware, credential theft, unauthorized access, denial of service attacks, or interference with Studio or another system.
- Dangerous instructions or deceptive Scenes likely to cause physical injury or harmfully misrepresent a person, property, product, or event.
- Attempts to evade moderation, quotas, billing, plan restrictions, security controls, or an earlier suspension.
Moshpit does not review every Scene or interaction before it appears. We may investigate reports, limit discovery, remove content, preserve evidence, or suspend accounts to enforce these Terms, protect users, or follow the law. Context or artistic value does not excuse illegal or exploitative use.
7. Rights complaints and feedback
If material in Studio infringes your copyright or another right, send a notice to the contact in Section 11. Include your contact information, the protected work or right, the disputed material and its location, a good-faith statement that the use is not authorized, a statement that your notice is accurate and that you can act for the rights holder, and your signature.
If we removed your material by mistake, you may send a counter-notice with your contact information, the material and its former location, a statement under penalty of perjury that removal was a mistake, consent to the applicable court, and your signature. We may share notices with the affected parties and restore material when appropriate and lawful.
Moshpit may limit or remove disputed material and may terminate repeat infringers. Knowingly false notices may create legal liability. If you send feedback about Studio, you allow Moshpit to use it without restriction or payment. This does not give Moshpit ownership of your Scene content.
8. Exports, changes, and availability
Other companies control their own products and policies. After you export a file from Studio, you are responsible for its storage, backup, compatibility, later use, and any license that applies to it. An exported file may not keep every Studio feature.
We may add, change, limit, or stop Studio features and may perform maintenance or respond to incidents. We will give reasonable advance notice if a change materially reduces a core paid feature, unless an urgent security, legal, or reliability issue makes notice impractical.
Self-serve plans do not include guaranteed uptime, guaranteed preservation of every file, or support for every browser, device, or export format forever. A signed Enterprise order may include different commitments.
9. Suspension, termination, and deletion
You may stop using Studio, cancel a subscription, deactivate your Studio account, or permanently delete it. Permanent deletion ends access and cancels an active subscription immediately. We do not give a prorated refund unless the law requires one.
We may limit or suspend access because of a security incident, payment failure, illegal conduct, a material breach, risk to other users, or a legal requirement. We may terminate access for a material breach that cannot be fixed or that you do not fix within a reasonable time after notice. We may act immediately to stop urgent harm.
After termination, permissions needed to run your account end except for the brief period needed to close it, records we must keep, existing Remixes, Public material already distributed under your settings, and clauses that still apply after termination. Deleting Studio does not delete your shared Moshpit identity account or another Moshpit product.
10. Warranties, liability, and disputes
To the fullest extent the law allows, Studio is provided "as is" and "as available." Moshpit disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that Studio will always work, be error-free or secure, or preserve every file. This does not limit a right that the law does not allow us to exclude.
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities. Moshpit's total liability related to Studio or these Terms will not exceed the greater of US $100 or the amount you paid Moshpit for Studio during the 12 months before the event that caused the claim. These limits do not apply where the law prohibits them.
If you use Studio for a business or organization, that organization will defend and indemnify Moshpit and its personnel against third-party claims caused by its content, illegal use of Studio, or material breach of these Terms, except to the extent Moshpit caused the claim. This duty does not apply to an individual consumer where the law prohibits it.
Before filing a formal claim, you and Moshpit will spend 30 days trying in good faith to resolve it after one party sends a written description of the dispute and requested solution. California law governs these Terms without applying its conflict-of-law rules. Unresolved disputes must be filed in a state or federal court in Los Angeles County, California, and each party agrees to those courts. Consumer rights and forums that cannot legally be waived still apply.
11. Changes, general terms, and contact
We may update these Terms when Studio, our business, or the law changes. We will post the new version and effective date. For a material change, we will give notice by email or in Studio and ask you to accept again when appropriate.
If a court cannot enforce one part of these Terms, the rest still applies. A failure to enforce a term is not a waiver. You may not transfer these Terms without Moshpit's written consent. Moshpit may transfer them as part of a reorganization, financing, merger, acquisition, or transfer of the related business. Neither party is responsible for delay caused by events outside its reasonable control, except for payment duties.
